Some points for clearness

The model itself is marked as "stolen". And this model was taken from googles 3D Warehouse? Are both are true?

I think the situation has been resolved. The video, at least, now states
"This track was created by Youtube user turbotim33. I originally took the track without permission and claimed it as my own. I apologize to him and the viewers for lying. I will not release anymore versions of this Custom Track at his request."
However, I notice both my comments and TurboTim's comments where we confronted him about the issue have been deleted from the video, as was the thread Tim made on the MKWii forums. :--Jefe 15:04, 9 February 2013 (UTC)
Whoever has posted the model to the 3D Warehouse, he gave a licence to everyone:
"Rights granted to other end users of the Services. You give other end users of the Services a perpetual, sublicensable, irrevocable, worldwide, royalty-free, and non-exclusive license to reproduce, adapt, modify, translate, publish, publicly perform, publicly display and distribute Existing Geolocated Models, Existing Non-Geolocated Models, New Models and related content and derivative works thereof which you submit, post or display on or through, the Services."
That's my reason for asking.

I agree. The main issue here was proper attribution. The track maker originally represented this as his own work. This has now been corrected. The secondary issue is track etiquette. Once a model is posted to the warehouse, the assumption is that is for people to use as they please. So by that measure, the model's author cannot simply demand that the track made from his model be taken down or that drastic changes be made to the track. However, I believe that the track maker should make a reasonable attempt to respect the model maker's wishes. This situation would have gone much smoother had the track maker contacted the model maker before he started working the track.

I think the best possible outcome here is for the two of them to collaborate to make the track better, rather than abandoning it. --Jefe 19:13, 9 February 2013 (UTC)

But then, the word "stolen" is definitely wrong. I hope, that anyone with better english knowledge than me will find more accurate words.
